www.creativelounge.io (the "Site") is the personal portfolio of Samar Shool, presented under the name The Creative Lounge ("I," "me," "my"). By accessing or using the Site, you agree to these Terms & Conditions ("Terms"). If you do not agree, please do not use the Site.
1. Use of the Site
You may view and browse the Site for your own personal, informational, and non-commercial purposes. You agree not to misuse the Site, interfere with its operation, attempt to gain unauthorized access, or use it in violation of any applicable law.
2. Intellectual property
The design, layout, structure, text, and branding of this Site — including the "The Creative Lounge" name and logo — belong to me. The creative work, imagery, reels, and project examples featured on the Site were produced for or in collaboration with clients, studios, employers, or other parties, and the rights to that work, together with any trademarks, products, and brands shown, remain the property of their respective owners. Such work is displayed here for portfolio and demonstration purposes only, and no ownership of third-party material is claimed.
Regardless of who owns a given item, you may not copy, reproduce, download, republish, distribute, modify, or create derivative works from any content on the Site, in whole or in part, without the prior written permission of the relevant rights holder.
3. Portfolio and client work
Displaying client or third-party work on the Site does not imply any current endorsement, partnership, or affiliation, and does not grant you any rights to that work. If you are a rights holder and would like a credit adjusted or a piece removed, please reach me through my contact form and I will respond promptly.
4. No professional reliance
Information on the Site is provided for general informational purposes and to showcase my work. It does not constitute professional, technical, or business advice, and you should not rely on it as such.
5. Proposals and engagements
Any proposal, quote, estimate, or message exchanged through or in connection with the Site is for discussion only and does not create a binding agreement. Any actual engagement for services will be governed by a separate written agreement signed by both parties, which will control in the event of any conflict with these Terms.
6. Third-party links and platforms
The Site may contain links to third-party websites and platforms (such as Vimeo and IMDB). I provide these for convenience only and do not control, endorse, or assume responsibility for their content, products, or practices. Accessing them is at your own risk and subject to their terms.
7. Disclaimer of warranties
The Site and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. I do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
8. Limitation of liability
To the fullest extent permitted by law, I will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of (or inability to use) the Site, even if advised of the possibility of such damages.
9. Changes to the Site and Terms
I may modify, suspend, or discontinue any part of the Site at any time without notice. I may also update these Terms from time to time; the "Effective date" above shows the latest revision. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
10. Governing law
These Terms are governed by the laws of the State of Maryland, United States, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Maryland, unless otherwise required by applicable law.
11. Resolving disputes
If you have a concern or dispute about the Site, please contact me first through my contact form so we can try to resolve it informally before any formal action is taken.
12. EU users
If you are a consumer in the European Union, you keep the benefit of any mandatory consumer-protection provisions of the law of the country where you live, and nothing in these Terms limits those rights.
13. Severability and waiver
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force and effect. My failure to enforce any right or provision of these Terms will not be treated as a waiver of that right or provision.
